Court of Appeal changes Family Law
A recent Court of Appeal hearing has changed the rules regarding partners who hide information when in the process of divorce. Until recently, a partner could seek information and present it to the Court if they had reasonable grounds that their partner was hiding assets.
This was thought to be an important way of addressing situations where a millionaire may be hiding assets in order to keep their partner from getting their fair share.
However, in this case Robert and Vincent Tchenquiz were trying to use information regarding the financial affairs of their sister’s multi-millionaire husband at her divorce hearing. The Judge ruled however that the confidentiality of the party was more important than said person revealing their assets.
As a result this will remove the protection afforded to those who felt the Court was being misled. This is a big change for Family Law, and future divorces cases will determine if this case law is to be challenged and how it will shape this area of Law.
