What is a Solicitor?

 

Brendan Fleming heads a team of solicitors in Birmingham; but what exactly is a solicitor, what do they do and how can they help you?

Despite most British towns having at least one firm of solicitors, many people are unclear as to why we're here and what we can offer.

Simply put, solicitors give legal advice and offer legal services so you'll also hear us referred to as lawyers.

There are two types of lawyer: solicitors and barristers. A barrister is a legal professional who represents you in court. A solicitor is a legal professional who gives legal advice generally, and if it becomes necessary, will arrange for a barrister to represent you in court. A solicitor can also represent you in court, but only in lower courts.

What, then, are legal services? They represent a wide range of services and could be, for example, the conducting of the sale of a business, the preparing of wills for husband and wife, the drawing up of a charter for a local Working Men's Club, the helping of an employee prepare an unfair dismissal claim, the buying of a house, the drawing up of contracts between companies, the suing of someone, the preparing of a Lasting Power of Attorney, the offering of "no win, no fee" personal injury claims, the advising of a person at a police station, the assisting of take-overs of multi-million pound businesses, and so on and so on.

However, no one solicitor is an expert on all these areas. At Brendan Fleming we have solicitors who specialize in public law, family matters, civil and commercial litigation, children's proceedings, conveyancing and wills and more. Like all solicitors, none of the team are experts on all the law (it would be foolhardy to attempt it!), and instead they specialise so that they can offer the best service possible.

These days, non-solicitors are allowed to offer some (but not all) legal services. Sometimes these provide a good service; sometimes not. Many issues are sufficiently importanty that people prefer to head for a firm of solicitors for assistance. With this comes the reassurance of professionals who have undergone structured and well regulated training over many years, and undergo mandatory training on an ongoing basis; and who operate under close regulation of the business by the Solicitors Regulation Authority, an independent body with the dual aims of ensuring excellent service and satisfaction for clients.
