This is a case where the children suffered significant bruising in the care of the mother. The LA pursued a case of NAI. A paediatrician and haematologist were instructed. Both experts concluded that there was no underlying medical reason for the bruising. The Paediatrician concluded that a number of the injuries were concerning of NAI. The mother challenged this evidence. As proceedings progressed it became apparent that the children continued to suffer bruises whilst in foster care. Those bruises appeared in similar places to the bruises that were observed to the child whilst in the mother’s care. The local authority, reflecting on the totality of the evidence, no longer sought to plead NAI.
