Spiral Fracture to Femur

In this case we represented a mother.  One of their children had sustained a spiral fracture to the left femur.  It was the opinion of the treating clinicians that this was non-accidental as the explanation offered of an older child bouncing on the bed where the child was asleep and possibly landing on the child was not considered as consistent with the injury.  A paediatrician and radiologist was instructed in this matter.  After a finding of fact hearing, the court found that the injury was accidental in nature and that it had been caused by a purely unfortunate accident as described by the parents.  The children were returned to the care of the parents and the case was dismissed.
